Role Purpose:
To manage and oversee all commercial, contractual, and financial aspects of construction projects, ensuring risk mitigation, contract compliance, and optimization of commercial performance in line with the company's objectives and UAE legal requirements.
Key Accountabilities:
Contract Administration · Review, draft, and negotiate contracts, subcontracts, and agreements ensuring consistency with company policies and UAE construction law. · Administer post-award activities including claims management, change orders, extension of time requests, and final account settlements. · Ensure adherence to FIDIC and other relevant contract standards throughout project delivery. Cost and Financial Management · Establish project budgets, cost plans, and forecasts in coordination with Project Managers and Quantity Surveyors. · Monitor cash flow, prepare monthly valuations, manage variations, and oversee project invoicing and certification processes. · Analyze commercial performance, report regularly on project profitability, and advise senior management on cost-related matters. Procurement and Subcontract Management · Develop procurement strategies aligned with project schedules and budget requirements. · Review subcontractor agreements and ensure scope alignment and risk mitigation. · Approve subcontractor payments, variations, and claims based on contractual entitlements and project progress. Risk Management and Dispute Resolution · Identify commercial and contractual risks, propose mitigation measures, and ensure early resolution of potential disputes. · Prepare documentation for claims, arbitration, and litigation where required, in coordination with Legal Counsel. Team Leadership and Development · Supervise and mentor a team of Quantity Surveyors, Contract Administrators, and Commercial Officers. · Conduct performance appraisals, identify training needs, and promote continuous improvement within the commercial function. Stakeholder Management · Serve as the commercial interface between the company, clients, consultants, and subcontractors. · Provide contractual and commercial support to project teams to ensure compliance with company and client requirements.
Bachelor's Degree in Quantity Surveying, Civil Engineering, Construction Management, or a related field. · Minimum of 10 years of experience in a commercial and contracts management roles, preferably in construction sector. · Proven track record of successfully managing commercial activities and driving business growth. · Strong negotiation, contract management, and financial management skills. · Ability to think strategically and · Implement innovative solutions. · Proficiency in using commercial management software and tools. · Knowledge of the UAE market and regulatory environment is highly desirable.
